Account Terms
Creating accounts using automated methods is not allowed on VoteClick.
To keep your account secure, we offer password protection combined with two-step verification. We also provide a password reset mechanism. As the account owner, it is your responsibility to keep your login credentials secure. We highly recommend using strong passwords.
Please note that VoteClick cannot be held responsible for any loss or damage arising from your inability to access your account.
You are responsible for all activities carried out using your account.
You may not use VoteClick for any illegal or unauthorized purpose, including sending unsolicited (“spam”) messages.
You are solely responsible for your conduct and any data that you transmit or display through the service, and for any consequences thereof.
You agree to use the service only for purposes that are legal, proper, and in accordance with these Terms of Use and any applicable laws or regulations.
You are solely responsible for ensuring that your use of the service does not violate any laws or regulations in your jurisdiction.
Payment Terms
Our platform facilitates payments through major credit cards, Google Pay, and Apple Pay. All transactions are securely handled via Stripe, a well-established and trusted payment gateway. Please note that your credit card details are transmitted directly to Stripe without passing through our servers.
Please be aware that we do not provide refunds.
In case of account termination due to prolonged inactivity, any residual account balance will be considered forfeit. This balance cannot be refunded or transferred. Users consent to this policy by using our services. We strongly encourage you to utilize your account balance before periods of extended inactivity.
Please note that all our fees do not include any taxes, levies, or duties that may be levied by tax authorities. You are accountable for the payment of any such additional charges.
Cancellation and Termination
You may delete your account at any time via the "Settings" screen. Upon deletion of the accouunt, your information will be deleted from our servers.
VoteClick reserves the right to suspend or terminate your account and refuse any current or future use of our services for any reason at any time. In case of a violation of the Terms of Use, we reserve the right to take any action we deem necessary to protect the integrity of our system, including reporting the violation to the appropriate authorities. In such cases, we may terminate your account immediately without any prior notice.
Modifications to the Service and Prices
VoteClick may modify or discontinue its services at any time, with or without notice. This includes changes to the features, functionality, and pricing of our services.
We will not be held liable to you or any third party for any modification, price change, suspension, or discontinuance of our services.
Copyright and Content Ownership
The data you upload to your VoteClick account remains your property.
VoteClick does not pre-screen the content uploaded by users and cannot be held responsible for the content's accuracy or legitimacy.
By uploading any content to your VoteClick account, you warrant that you have the necessary rights to do so and that the content does not infringe on any third-party rights.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by VoteClick.
General Conditions
The use of VoteClick is at your own risk. The service is provided on an "as is" and "as available" basis, without any warranties or guarantees.
VoteClick does not guarantee that its service will be uninterrupted, secure, or error-free.
While we take every reasonable measure to maintain the security of our service, we cannot guarantee that it will be completely immune to unauthorized access or hacking attempts. Like any software, VoteClick may be vulnerable to certain security risks despite our best efforts.
You agree that VoteClick will not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if VoteClick has been advised of the possibility of such damages), resulting from:
- Your use or inability to use the service.
- Unauthorized access to your account.
- Statements or conduct of any third party on the service, or any other matter related to the service.
The failure of VoteClick to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.
The Terms of Use constitute the entire agreement between you and VoteClick and govern your use of the Service, superseding any prior agreements between you and VoteClick (including, but not limited to, any previous versions of the Terms of Use).
As an administrator, you are required to share certain information about your voters to create the voting process. However, VoteClick warrants that it will undertake commercially reasonable efforts to safeguard voter information and ensure the privacy of said information as per our privacy policy.
Disclaimer of Liability
VoteClick is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising from the use or inability to use our service.
Additionally, we are not responsible for any statements or conduct of any third party on our service.
You agree to use our service at your own risk and to hold VoteClick harmless from any and all claims, damages, and expenses.
The limitations of liability set forth in these Terms of Use apply to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend and hold VoteClick, its officers, directors, employees, agents, and affiliates, harmless from any and all claims, damages, expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your use of our service, your content, or your violation of these Terms of Use.
